HIPAA and Our RoleReciraHealth is not, itself, a hospital, doctor's office, or health insurer, so it is not automatically a "covered entity" under HIPAA. Depending on the specific data-sharing arrangement with a given hospital or health system partner, ReciraHealth may act as that partner's "business associate" under HIPAA for the records obtained through that partnership, governed by a Business Associate Agreement. [Confirm and finalize this characterization, and the presence/terms of BAAs, with counsel before publishing.]Because ReciraHealth aggregates identifiable health information from multiple sources into a personal health record, it is likely a "vendor of personal health records" under the Federal Trade Commission's Health Breach Notification Rule, which applies independently of HIPAA. See Section 10.7. Data SecurityWe use administrative, technical, and physical safeguards designed to protect your information, including encryption of data in transit and at rest, multi-factor authentication, and access controls limiting who can view your information. [Describe your actual security program and any independent audits/certifications, e.g., SOC 2, HITRUST, once finalized.] No method of transmission or storage is completely secure, and we cannot guarantee absolute security.8. Data RetentionWe retain your information for as long as your account is active or as needed to provide the Service, and for a reasonable period afterward to comply with legal obligations. [Insert specific retention periods once finalized.]9. How We Match and Verify Your RecordsTo make sure the right records are linked to your account, we use a combination of identity verification information and provider-assigned medical record identifiers, along with standard health-data interoperability protocols (such as FHIR/HL7), rather than relying on a single identifier such as a Social Security Number. [This section should be finalized to precisely describe the actual matching method your engineering team implements, and reviewed by counsel.]10. Children's PrivacyThe Service is intended for use by adults managing their own health records, or by a parent/legal guardian managing records on behalf of a minor child through family sharing. We do not knowingly collect personal information directly from children under 13 in a manner inconsistent with the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided us information directly, contact us using the information in Section 12.11. Breach NotificationIf we experience a breach of unsecured, identifiable health information, we will notify affected individuals without unreasonable delay and no later than 60 calendar days after discovery, consistent with the FTC's Health Breach Notification Rule and applicable state law, including a description of what happened, the types of information involved, and steps you can take to protect yourself. Where 500 or more individuals are affected, we will also notify the Federal Trade Commission and, where required, prominent media outlets.12. Changes to This PolicyWe may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. The "Last Updated" date at the top of this Policy reflects the most recent revision.13.
